STATE OF CLAIM
1. The plaintiff is a spinster residing at No. 33N, Jalan Bandar Hilir, Melaka.
2. The defendant is the Chief Minister, Melaka
3. The plaintiff first met the defendant at Melaka Strait Inn in early 1982. The plaintiff was then working at the Melaka Strait Inn as a hostess.

Teman lelaki Josephine berkata, Josephine telah membatalkan samannya terhadap Ketua Menteri Melaka di Mahlamah Tinggi hari ini adalah kerana surat saman Josephine itu terlalu mudah dan pendek serta tidak cukup keterangan.

Josephine tinggal dengan keluarganya di-rumah pangsa tingkat 4. Hari ini dia tidak mahu menemui pemberita, hanya teman lelakinya yang menjadi orang perantaraan. Joshepine berkata, dia tidak mahu mengambil tahu dan campurtangan dalam hal politik. Dengan itu dia mengambil keputusan untuk membatalkan samannya itu.

Pada 13.9.85, Josephine menerusi peguamnya En. Karpal Singh telah ke Mahkamah Tinggi mengemukakan saman terhadap Dato Rahim Thamby Chik. Dia menuntut saman malu kerana tidak ditunaikan perkahwinannya dan ini telah mengganggu fikirannya.

4. The defendant befriended the plaintiff and used to take her out to varius places including Federal Hotel Kuala Lumpur, Ming Court, Port Dickson, Banglo Kerajaan, Tanjung Kling, Melaka, the defendant’s residences at Paya Ikan and Masjid Tanah, Melaka.
5. In Early 1982 and on several occasions thereafter the defendant promised to marry the plaintiff.
6. In reliance upon the said promises, the plaintiff allowed the defendant to have sexual intercourse with her on various occasions at the places mentioned in paragraph 4 herein.
7. In August or September, 1982 the defendant requested the plaintiff to resign as hostess. The plaintiff duly complied with the request.
8. The defendant presented the plaintiff wiyh a diamond ring, a watch and a camera.
9. On or about 10th March, 1984 the defendant broke off from the plaintiff without any reasonable cause. A few months the plaintiff saw the defendant at his oggice and requested him ti keep his word by marrying her. However, the defendant refused to relent.
10. The plaintiff was ready and willing to marry the defendant. However, in breach of his promises to marry the plaintiff, the defendant has refused to marry her.
11. As a result of the defendant’s acts, the plaintiff has suffered humiliation and mental anguish and has suffered loss and damage.
WHEREFORE the plaintiff prays for :-
(a) Damages;
(b) Costs and
(c) Any further or other relief deemed fit and proper by Honourable Court.
